Settlement at the Cost of Equity

Sabka Vishwas Scheme is a dispute resolution-cum-amnesty scheme, with an objective of generating revenue in the short term, by inclusion into the tax net of delinquent taxpayers and those with pending disputes. Such measures renegotiate the contract between the state and its citizens, hurting equity in the tax system. Adherence to such measures reduces the taxable capacity of the state in the long run, by adversely affecting motivation towards compliance.

Sabka Vishwas Scheme (SVS) is a dispute resolution scheme that covers under its umbrella all the legacy cases related to the service tax and central excise acts so far, and 26 other enactments. A dispute resolution-cumamnesty scheme by design, it includes all those who either did not pay the tax earlier, or have “cases” pending against them. A case as defined under the scheme covers all show cause notices and appeals, arrears, inquiries, investigations or audit, and also voluntary disclosure, barring only fraudulent cases and those pending with the settlement committee.1
