Capital Punishment

This is with reference to your editorial “Abolish Capital Punishment” (3 September 2011). The Constitution of India does not allow the president of India to exercise her own judgment on mercy petitions. The president is very much bound by the “advice” of the council of ministers. Please see the judgment of the constitutional bench (7 judges) of the Supreme Court in Samsher Singh (1974).
