CIVIL LIBERTIES Political Past of Public Servants A G Noorani IT is, indeed, unfortunate that a ruling of such importance as in state of Madhya Pradesh vs RamashanJcer Raghuvanshi and Another should have been delivered only by a Division Bench of two Judges of the Supreme Court and with one of them, Mr Justice S Murtaza Fazal Ali, declining saying that the state's appeal should be dismissed summarily. Mr Justice O Chinnappa Reddy delivered a judgment, however, and it embodies consequently the ruling as pronounced by only a single judge as an obiter. That is no reason why the judgment should be ignoredIt deserves wide attention.
