The effect of proper authentication is clearly mentioned in Article 77(2); "the validity of an order of instrument which is so authenticated shall not be called in question on the ground that it is not an order or instrument made or executed by the President." If a properly authenticated order must be deemed in law to have been made by the President himself, there is no reason for its reference to the Council of Ministers or to the President* as Justice Jain suggests. The fact that the President has "not allocated the matter to any Minister" under the Rules of Business becomes immaterial in the face of an order of the President himself. Tersely put, compliance with Clause (2) of Article 77 through proper authentication cures the defect of non-compliance with Clause (1) as well as non-com- pliance with Clause (3) of not making an appropriate allocation.
