Most of the accused had already been taken into custody either under preventive detention laws or in connection with criminal charges when the charge-sheet in the Par- vathipuram case was filed. This means that many of those implicated in the case spent as long as nine years in prison though the case against them was not proved. It is a clear case of miscarriage of justice, of sentence of imprisonment by an executive diktat. It took six years after the charge-sheet for the sessions trial to be completed and another three years for the High Court to dispose of the appeal.
