Similarly, impowering government to use patents for its own purposes or for the use of government hospitals is unexceptionable and there is a similar provision in the British patents law. Some justifiable objection may be raised to the ceiling of 5 per cent on royalty. It could be argued that in a long-term statutory enactment of this kind a firm ceiling need not have been prescribed and instead the, amount of royalty could have been left to be discussed between the two parties concerned and finally fixed with the consent of government.
