On 9 August 2017, the Supreme Court of India clarified that intercourse or a sexual act by a man with his wife, who is not below the age of 15 years, is not marital rape. This raises a number of questions about marital rape, the age and nature of consent, child-marriage and its space in the legal discourse, and the failure of the law to protect all minors equally.
